Terms and Conditions Callysta; internet sales
Article 1. Definitions
1.1. www.Callysta.nl: online webshop of Callysta BV, registered with the Chamber of Commerce under file number 58065024.
1.2. Distance contract: an agreement whereby, within the framework of a system organized by Callysta for the distance selling of products, up to and including the conclusion of the agreement only one or more techniques for distance communication are used.
1.3. Agreement via internet: a (purchase) agreement at a distance, closed via internet.
1.4. Client: the natural person who does not act in the exercise of profession or business and enters into an agreement via the Internet with Callysta.
1.5. General Terms and Conditions: the whole of the provisions as listed below.
1.6. Website: www.Callysta.nl
Article 2. Applicability
2.1. These General Terms and Conditions apply to all agreements via the Internet, as well as to the related offers and deliveries of Callysta (www.callysta.nl and www.callystajewels.com), unless explicitly agreed otherwise in writing.
2.2. Before the agreement is concluded via the Internet, the text of these General Terms and Conditions will be made available to the Customer. In order to place a purchase via the internet, the Customer must first agree with the text of the General Terms and Conditions of Callysta by checking the box ‘I agree with the General Terms and Conditions’.
2.3. The General Conditions can also be read and printed via the Callysta.nl website, under the General Terms and Conditions menu.
Article 3. Information
3.1. The seller is Callysta BV, e-mail address: firstname.lastname@example.org
3.2. The main characteristics of the product, the price and the costs of delivery are clearly indicated to the Customer during the ordering process.
3.3. All prices and offers include VAT and other levies imposed by the government.
3.4. Callysta is entitled to engage third parties in the performance of its agreements.
3.5. The invoice and delivery address of the Customer may not be a PO Box.
Article 4. Offers
4.1. Callysta offers and prices are valid during the period indicated on the website.
4.2. All prices on the website are subject to typing errors. Obvious mistakes or errors in the offer, whereby the Customer can know that there is a mistake or error, do not bind Callysta.
Article 5. Agreement / payment / delivery
5.1. If the Customer has accepted the offer electronically, Callysta will immediately confirm receipt of that acceptance by e-mail. This order confirmation states: – the identity and address of Callysta; – the main characteristics of the purchased product; – the price, including all taxes, of the product; – the costs of delivery; – the method of payment; – the method of delivery; – the statement that the Customer has the right to terminate the contract within 14 days after receipt of the product without giving any reason.
5.2. The Customer must pay the payments to Callysta according to the method stated in the order confirmation.
5.3. As soon as the full payment has been received by Callysta, Callysta will send the product to the Customer as soon as possible, but in any case within five working days. Upon delivery, a written confirmation is sent again of the information referred to in article 5.1. listed data.
5.4. Delivery takes place while stocks last. If delivery of an ordered product after the conclusion of the agreement turns out to be impossible, Callysta will refund the purchase price already paid by the Customer as soon as possible, but in any case within five working days after receipt of the payment to the Customer.
5.5. Once the product to be delivered has been delivered to the specified delivery address, the risk, as far as this product is concerned, passes to the Customer. The address that the Customer has given to Callysta counts as the delivery address.
Article 5.A Payment by Klarna
In cooperation with Klarna Bank AB (publ), Sveavägen 46, 111 34 Stockholm, Sweden, we offer you the following payment methods. Payment is to be made to Klarna.
- Pay in  days: The payment period is 14 days from shipment of the goods or tickets/ availability date of the service. You can find the complete terms and conditions for the markets where this payment method is available here: , , , , , , , and the .
- Financing: With the financing service from Klarna you can pay your purchase in flexible or fixed monthly instalments according to the conditions stated in the checkout. The instalment payment is due at the end of each month after submission of a separate monthly invoice by Klarna. - Direct bank transfer: Available in Germany, Austria, Belgium, Italy, Spain, Poland and the Netherlands. Your account will be debited directly after placement of your order.
- Direct Debit: Your account will be debited after shipment of the goods or tickets/ availability date of the service or in case of a subscription in accordance with the timelines communicated. You will be notified about the date(s) by email.
- Card Payments: Available in Sweden, Germany and Austria. The amount will be reserved on your card and will be debited after shipment of the goods or tickets/ availability date of the service. In case of a subscription the amount will be debited in accordance with the timelines communicated.
The payment methods Pay in  days, Slice It and direct debit are only available in case of a positive credit assessment. For this purpose, during the order process and handling of your purchase, we forward your data for an address and credit check to Klarna. We can only offer you the payment methods available based on the result of the credit check. General information about Klarna and the user terms per country can be found on . Your personal data is handled in accordance with applicable data protection law and in accordance with the information in Klarnas privacy statement.
Article 6. Exchange
6.1. The customer can exchange the purchased product within seven working days of receipt by returning the product to Callysta. If the price of the new product to be delivered differs from the exchanged product, the difference will be refunded to the Customer as soon as possible, but in any event within thirty days of receipt of the exchange order, at a lower price. At a higher price, the Customer will receive a new order confirmation with payment instructions for the difference. Customer must transfer the difference to Callysta. After receipt of this payment, the product will be sent to the Customer as soon as possible, but in any event within thirty days.
6.2. Return must take place to the following address: Callysta BV, Kleine Houtstraat 26, 2011 DM in Haarlem, The Netherlands. Proof of the shipping date is the proof of delivery to be submitted by the Customer.
6.3. The costs for returning the product in and from the Netherlands are for the account of the Customer. The costs for returning the product outside the Netherlands are also at the expense of the Customer.
6.4. Conditions for returning. The product must be in its original state and in an unworn condition, without the smell of perfume, perspiration or smoke or other signals that the product has been worn. The labels must still be on the product. The packaging of the product must be undamaged and in an impeccable condition. Returned products with a torn or broken package, which in our opinion can no longer be sold, are not accepted. Callysta reserves the right to refuse returned products and / or the customer the amount for repair or loss in value on the basis of the aforementioned reasons.
6.5. Callysta is never liable for any damage, theft or loss that is included in the packaging or the product when it is returned.
Article 7. Returns and time for reflection
7.1. If the delivered product does not meet the expectations of the Customer, the Customer can return the purchased product to Callysta within fourteen working days after receipt, after which Callysta will inform the Customer by e-mail within 1-2 working days after receiving the product.
7.2. Dispatch must take place to the following address: Callysta BV, Kleine Houtstraat 26, 2011 DM in Haarlem, The Netherlands. Proof of the shipping date is the proof of delivery to be submitted by the Customer.
7.3. The costs for returning the product in and from the Netherlands are for the account of the Customer. The costs for returning the product outside the Netherlands are also at the expense of the Customer.
7.4. Conditions for returning. 7.6. In accordance with the Dutch Sales or Distance rules, the Customer has the right to cancel an order for new items within fourteen days with a receipt or invoice, without giving a penalty or a reason. The Customer will receive the amount of the order within no more than 5 working days after receipt of the returned product.
Article 8. Warranty
8.1. Callysta uses as a warranty period for a product the prescribed warranty period of the manufacturer of the product.
8.2. Complaints can not be processed without proof of purchase. Proof of purchase also means a printout of the confirmation e-mail as mentioned in article 5.1. or the written confirmation referred to in Article 5.2.
Article 9. Force majeure
In case of force majeure, Callysta has the right to postpone or cancel an order without legal intervention by informing the Customer by email. Callysta is not obliged to pay compensation for the resulting damage to the Customer.
Article 10. Final provisions
10.1 All rights, obligations, offers, orders and agreements to which these Conditions apply, as well as these Terms and Conditions, are governed exclusively by Dutch law.
10.2 Disputes between parties can be submitted to the competent court in the Netherlands.
